Not everyone needs to engage in mediation or immediately commence litigation at the start of their divorce case. A negotiated settlement may be possible if both parties are willing to work together to exchange the necessary documentation, so they each can make informed decisions, and direct their counsel to attempt to settle their case outside of the formal court, mediation, or collaborative process.

A negotiated settlement involves lawyers working with their respective clients to negotiate the various issues in their case amongst themselves. If no settlement is reached, the couple can still employ the services of a mediator to attempt to resolve any remaining issues, or pursue litigation if no settlement is viable.
